DECREE ON PROTECTION OF INVESTMENTS

To ensure the supremacy of law, protect people’s right to the freedom of economic activity, protect business and investments, improve the investment climate in the Republic, and promote domestic and foreign investments by way of providing a fair and equitable legal regime for the investors and securing all investments made into the economy of the Kyrgyz Republic, based on the Provisional Government’s Decree #1 as of 7 April 2010, the Provisional Government has adopted this Decree #23 as of 26 April 2010:

1. The Provisional Government shall guarantee the supremacy of law within the territory of the Kyrgyz Republic;
2. Economic and business activities in the Kyrgyz Republic shall be implemented in compliance with the Constitution and laws of the Kyrgyz Republic and duly executed international treaties and agreements the Kyrgyz Republic has entered into;
3. Pursuant to the Kyrgyz Law “On Investments in the Kyrgyz Republic”, domestic and foreign investors shall be guaranteed a fair and equitable legal regime including guarantees for protection of their investments in the economy of the Kyrgyz Republic.
4. Foreign citizens staying in the Kyrgyz Republic on legal grounds shall be guaranteed the freedom of movement and travel within the country;
5. The Provisional Government shall procure the performance of all obligations previously assumed by the Kyrgyz Republic under the duly executed international treaties and agreements;
6. The Ministry of Internal Affairs, local state administration agencies and local self-government agencies shall take all appropriate measures to ensure the implementation of this Decree;
7. Any officials and other persons impeding the promotion of investments, taking any actions related to the illegal seizure of state, municipal, private, public or any other property including interference in the business activities and employment issues of companies and organizations, or assisting other persons in such actions (raids) shall be subject to criminal and civil penalties;
8. The State Ministry of Foreign Affairs and Ministry of Economic Development shall inform the international community and business enterprises of this Decree;
9.  This Decree shall come into effect upon signing.
